A Telephone?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Social media, like a telephone or newspaper, is the most common discussion that has taken place during the debate. They also mentioned the wide array of companies and social services that they could cover.&nbsp;<\/p>\n\n\n\n<p>Early on, <strong>Justice Sonia Sotomayor <\/strong>bemoaned how &#8220;so unspecific&#8221; and &#8220;so, so broad, it&#8217;s covering almost everything&#8221; the Florida statute was. She went on to say that there is &#8220;infinite variety&#8221; on the internet and questioned if the state should be responsible for defining it.<\/p>\n\n\n\n<p>Similar concerns were voiced by <strong>Justice Amy Coney Barrett,<\/strong> who claimed that Florida&#8217;s law was &#8220;very broad&#8221; and may apply to ride-hailing apps like Uber, Google&#8217;s search engine, and Amazon&#8217;s online store in addition to &#8220;traditional&#8221; social networking platforms.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Judges_Consider_Sending_Cases_Back_To_Lower_Courts_For_Further_Review\"><\/span><strong><strong><strong><strong>Judges Consider Sending Cases Back To Lower Courts For Further Review<\/strong><\/strong><\/strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Few justices broached the possibility of sending the case back to the lower courts. It wasn&#8217;t apparent, though, whether they would address the problem directly or whether there was agreement on it.<\/p>\n\n\n\n<p>At one point, <strong>Justice Elena Kagan <\/strong>raised the question of whether it was ever possible for a law to forbid viewpoint discrimination in situations where it was not necessary to take into account concerns about businesses&#8217; rights to &#8220;editorial discretion,&#8221; using Venmo, Uber, <a href=\"https:\/\/www.dropbox.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Dropbox<\/a>, and Gmail as examples.<\/p>\n\n\n\n<p>&#8220;You&#8217;re not engaged in speech activities when you&#8217;re running Venmo,&#8221; the speaker asserted, setting the company apart from news feed-curation platforms like Facebook and YouTube. Paul Clement, the legal representative for tech trade associations <a href=\"https:\/\/ccianet.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">CCIA<\/a> and <a href=\"https:\/\/netchoice.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">NetChoice<\/a>, resisted. &#8220;Those are all still part of the expressive business,&#8221; he stated.<\/p>\n\n\n\n<p>The justices also discussed whether an online retailer like Etsy would be subject to the regulations. According to Kagan, &#8220;Etsy is a supermarket that wants to sell only vintage clothes, so it will and does limit users&#8217; content.&#8221; &#8220;They will need to exercise censorship.&#8221;&nbsp;<\/p>\n\n\n\n<p>The recent argument in the Supreme Court has raised various questions and has illuminated the key challenges when it comes to shaping the regulations around social media platforms.
